Your fax received ,and note your action against Maple will start next wee\with regard to the information you require I do not have any such documentation ..Re Excelair and Unique Travel the latter were instructed by the Board of Enquiry to produce records of accounts and travel records for their services to Maple/Bartolo & Excelair but chose not to do so and were never called to account for not doing so. Excelairs documents and accounts were never raised as an issue by any of the lawyers or government legal representatives attending any of the ten sittings which I attended.
I do recall that on three occasions at which he attended Mr. A Fenech the Engineering Manager of the company which carried out the regulation maintenance and services to 9H-ABU stated he could not reconcile the condition of the plane as reported and recorded by Rodney Woods in his evidence to the court with that of the aircraft 9H-ABU which his company had serviced only four weeks previously, when asked to produce the records of that work Mr. Fenech stated he was unable to do so because all his paper and computer records relating to that plane had been confiscated by quote "The Authorities" Police-Civil Aviation on the morning of Monday 4th December 1995. These statements by Mr. Fenech are recorded in the various transcripts. There were numerous requests by the Board for the production of documents/records which were never forthcoming and the Board never followed up on its requests, I wonder why???
I do not have nor have I ever seen the Maltese Writ / Summons Sorry.
